These Terms of Use & Conditions “The Agreement” contain the terms, covenants, conditions and provisions “Terms and Conditions” upon which you may access and use the Easycustomboxes.com™ “The Sites” or any of the products or services available through the Sites. The terms “We,” “Our,” and “Us” refer to Easy custom boxes, Inc. d/b/a Easycustomboxes.com™, The owner and administrator of the Sites, and its officers, directors, employees, licencors, suppliers, vendors, content providers, partners, staff, affiliates, agents and representatives (collectively, the “Affiliated Parties”).
You may be referred to as “You,” “Customer,” or “User” in this Agreement.

COPYRIGHTS AND TRADEMARKS

You may not place or reproduce any trademarks, service marks, or logos that are not owned by you or licensed to you onto materials and merchandise to be printed via the Easycustomboxes.com™ Service.
Words, names, and designs used to identify services or products are considered trademarks, service marks, and/or logos.
The same policy is applicable for copyrights. You cannot use unlicensed copyrighted materials from photographers, artists, publishers, composers, writers, and other authors of original works.
The copyright owner’s exclusive rights prohibit the reproduction of any original work.
Easycustomboxes.com™ policy also states that you cannot use explicit language or pornography on printed materials and merchandise.

CUSTOMER CONTENT

You understand that all information, data, text, photographs, graphics, messages or other materials “Content” are the sole responsibility of the person from which such Content originated, This means that you, and not Easycustomboxes.com™, are entirely responsible for all Content that you send, upload, post or otherwise transmit via the Service.
Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content.
You agree to not use the Service to send, upload, post or otherwise transmit any Content that contains
(i) Child pornography or anything indecent, obscene, lewd, lascivious, filthy or vile;
(ii) A threat to kidnap or injure a person, a threat to injure the personal property or reputation of another person, a threat to accuse any person of a crime, a threat to inform another that a person has violated any law of the United States, or a threat of blackmail;
(iii) Any matter advocating or urging treason, insurrection, or forcible resistance to any law of the United States;

Easycustomboxes.com™ does not control the Content posted by Customers and does not guarantee the accuracy, integrity or quality of the Content. Under no circumstances will Easycustomboxes.com™ be liable to you in any way for any Content you may be exposed to that you may find offensive, indecent or objectionable.
Products and services, such as e-business cards, e-photo cards, and e-invitations are provided for your personal use only.
You agree to abide by these terms of service and not to use these products and services or related messages for any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation.

You understand that you control the privacy of any Content you elect to post by granting access under your personal password.
When you, or someone to whom you have given access, orders a print item using your password, you grant Easycustomboxes.com™ the world-wide, royalty free and non-exclusive license to use, reproduce, sub-license, modify, adapt, publish, display and create derivative works from the Content on the Service and on the printed product for the purposes of storing designs or processing print orders.
This license exists only for the length of time necessary for Easycustomboxes.com™ to complete your order or until you delete the Content from the Service.
You acknowledge that Easycustomboxes.com™ does not pre-screen Content, but that Easycustomboxes.com™ and its designee shall have the right (but not the obligation) in their sole discretion to remove any Content that violates the terms of service or may otherwise be objectionable.
You further acknowledge and agree that Easycustomboxes.com™ may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process;
(b) enforce the terms of service;
(c) respond to claims that the Content violates the rights of third-parties;
(d) protect the rights, property, or personal safety of Easycustomboxes.com™, its users and the public.

DESIGNING FILES

Easycustomboxes.com™ is offering Free Designing Services with each new order placed.
Designing services would be charged per hour basis otherwise or in case of order cancellation at later stage.
Fair Usage Policy is applied.
Easycustomboxes.com™ will only provide design files at 72 DPI (low resolution).
Higher resolution designed files can be purchased and will be priced individually.
Please contact support@Easycustomboxes.com, if you would like a price quote for your high resolution designed files.

CUSTOMER SUBMITTED DESIGN

All artwork or designs and images must be provided in CMYK format.
Easycustomboxes.com™ is not responsible for any color shift that occurs in conversions from RGB to CMYK color modes.

All artwork, designs and images must be provided in minimum of 300 DPI and CMYK format.
Easycustomboxes.com™ is not responsible for images printed as fuzzy, distorted, or pixelated due to customer provided artwork.

COLOR PROOFING & MATCHING

Easycustomboxes.com™ is not liable for color matching or ink density on screen proofs approved by the customers.
Screen proofs will predict design layout, text accuracy, image proportion and placement, but not color or density.

Easycustomboxes.com™ will try it’s best to match the gradient density of each color in a duo-tone, Easycustomboxes.com™ is not liable for the final appearance of a duo-tone unless the customer orders a color match proof for that order/job.

Application of lamination may affect or change the appearance of the printed colors.
Easycustomboxes.com™ is not liable for the final color appearance of a laminated products.

MATERIALS

Please note that the paper/card stock used for printing for our products is not food grade. any such requirement should be communicated in writing immediately. If you’ve any specific food grade requirement with regards to paper stock, please let us know before placing this order.

CUSTOMER IS RESPONSIBLE FOR PROOF AND LAYOUT APPROVAL PRIOR TO THE PRINTING

Easycustomboxes.com™ is NOT LIABLE for errors in a printed product caused by any of the following:
Graphics Orientation or Placement and Incorrect Font Usage

Spelling, Grammatical and Punctuation Errors

Wrong Die cuts, slits or Incorrect and Missing Folds

Finished Product Size

COLOR ACCURACY AND HARD COPY PROOFS

Easycustomboxes.com™ will reproduce color from submitted print-ready files as closely as possible. However, Easycustomboxes.com™ cannot guarantee color match and color density because of limitations in the printing processes, different properties of various printing surfaces, as well as neighboring image ink requirements.
The accuracy of color reproductions is guaranteed to be within 90% of the final proof you approved.
Please note that Easycustomboxes.com™ can only guarantee color reproduction for your print-ready files if you order a hard copy proof for an additional charge.
Please note that Easycustomboxes.com™ is not responsible for color variations between submitted print-ready images and the actual artwork or product they represent.

INDEMNITY

You agree that you shall indemnify and defend Easycustomboxes.com™ and all parties from whom Easycustomboxes.com™ has licensed portions of Content, and their directors, officers, and employees, against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses arising out of or related t;
(i) Your breach of these Terms and Conditions or
(ii) any suit, claim, or demand arising from or relating to any text, photograph, image, graphic or other material you incorporated into Products that was not part of the standard Site Content.

PAYMENT TERMS

Since all orders are produced from scratch and fully customized, so Payments are taken upfront.
We accept major credit cards (MasterCard, AM EX, Visa and Discover), cheque and wire transfers.
All credit card payments can be made online through our site.

ORDER CANCELLATION

Easycustomboxes.com™ will cancel your order prior to printing/shipping.
However, if you’re ordered item has been shipped then it cannot be cancelled.
Orders may be cancel able during the various production stages, but cancellation charges will apply.
Our Customer Service Team will inform you of any cancellation charges.

1) Orders are placed on-line.

2) Orders are reworked in our design department.

3) Orders are sent to the press.

4) Orders are collected by the shipping firm and shipped.

All orders are cancel able before stage 2.If an order is cancelled in stage 1; you will be charged $15 plus 5% of the total amount to cover payment processing, bank charges and to cover our design department fees.
For orders cancelled in stage 2, minimum 20% of the total order amount is deducted as cancellation fees to cover our design department’s charges.
After an order enters stage 3, we can still try to cancel the order but we cannot guarantee order cancellation.
However, if the order is still in stage 3, and the user wants to have it cancelled; a minimum of 50% of the total order amount is deducted to cover expenses. Once an order reaches stage 4, it cannot be cancelled.

DESIGN ORDERS

Once an order has been placed successfully, No Refunds are issued for any design services orders.

RETURNS AND REFUNDS

As all orders are unique, All Sales Are Final. If we verify that we made an error, we will re-print the order. No Refunds or Credits.

RE-PRINTS

The customer must notify Easycustomboxes.com™ within 3 business days of order delivery of any defects, damage, or missing items discovered in the delivered products.
Easycustomboxes.com™ will not be responsible for any claims for defects, damage, or missing items that are not filed within 3 business days of the delivery date.

To receive replacement products, customer must return (at their own expense) at least 99% of the received product within 10 days of the initial order delivery date.

No returns will be accepted without prior written return authorization from Easycustomboxes.com™.

All charges related to expedite printing (rush printing or shipping) are NOT REFUNDABLE, including those orders that are returned for any reason, No Exceptions.

ORDER SHIPPING AND DELIVERY

Easycustomboxes.com™ offers following shipping options when placing an order.
Shipping options may vary on each product.

STANDARD SERVICE – (Shipping Time NOT GUARANTEED):

Free Ground Shipping within 48 contiguous states. Usually Ships within 10-12 business day after final proof approval. Final proof approval must be received by 12:00 PM EST of business day otherwise one business day will be added to the shipping time.
Shipping time for Standard Service is not guaranteed and is calculated based on our recent delivery history and may vary on each order.

EXPRESS SERVICE – Ships on the 8th business days, Plus Free Ground shipping included:
FREE Ground shipping included within 48 contiguous states. Products will be shipped within 8 business days after final proof approval. Final proof approval must be received by 12:00 PM EST of business day otherwise one business day will be added to the shipping time.

URGENT SERVICE – Ships on the 6th business days, plus 2 Day express shipping included:
FREE TWO-DAY EXPRESS shipping included within 48 contiguous states. Products will be shipped within 6 business day after final proof approval. Final proof approval must be received by 12:00 PM EST of business day otherwise one business day will be added to the shipping time. Two Day Express Shipping will be delivered on the next two business day and excludes Saturday, Sunday, and holidays.

Easycustomboxes.com™ will always act to make sure that any production difficulties do not delay delivery schedules.
In no case shall Easycustomboxes.com™ be liable for any consequential or damages resulting from any delay in shipment or delivery.

All Easycustomboxes.com™ customers agree not to hold Easycustomboxes.com™ liable for delays in shipments caused by weather conditions, shipping company delays, international customs issues or any other circumstances beyond Easycustomboxes’s direct control.
Easycustomboxes.com™ shipment and delivery dates are calculated based upon estimates provided by our suppliers and recent order history.
Easycustomboxes.com™ will always act to make sure that delivery schedules are met.
However, unexpected equipment failure, malfunction and or technical problems may delay the printing process. However, any delay caused by technical difficulty/problem, equipment failure, power outage, natural disaster, any sort of strike, will not be the grounds for order cancellation or refunds.
However, in case of rush orders, where applicable, ONLY Rush fee amount paid by customer will be refunded back if Easycustomboxes.com™ does not ship the order within the scheduled time.

PRINTING ORDER ROUTING

we have many affiliate printers in USA, Europe, Africa, and Asia. An order can be routed to a printer in any location depending on our technical problems, outage, Production queues, specifications, and complexity of the job without any notice to the customer.

DAMAGED AND LOST PACKAGES

Customers are responsible for inspecting all packages for any visible signs of damage or missing items (when compared to the items listed on the enclosed packaging slips or invoices) before accepting delivery.
In case of damage or missing items, the customers should notify Easycustomboxes.com™ and the delivery courier immediately.
Easycustomboxes.com™ will not be responsible for any damage or missing items claims that are not filed by the customer within 3 business days of order delivery.
Easycustomboxes.com™ is not responsible for 3rd party shipping errors, omissions, or damaged shipments.

Each ordered product is usually shipped with few extra pieces that are free of charge. Seldom order shipment may have slightly fewer pieces than ordered.
Printing trade standards allow for underages or overages of up to 5%. Therefore, if exact quantity is needed, then it is suggested that customers should order 10% over the required quantity.

Additional shipping and handling charges will be assessed for packages that have to be reshipped since an error was made by the customer in submitting the proper shipping address.

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANT ABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
